GMTV Competition Rules

1. Closing Date and Time: Competition closes for entries via PRTS and SMS at 12.00 p.m. each day in the case of a daily competition and 12.00 p.m. on Friday for weekly competitions. Entries made after the closing time will not be entered into the competition but may still be charged. Competition closes for entries online via www.gm.tv no less than three (3) working days after the last programme featuring the competition.

2. Method and Cost of Entry:
    * PRTS Phone - call 090 49 59 6000 and follow instructions; up to five entries per phoneline. Each call costs £1.00 from BT landlines. Calls from other networks may be higher and from mobiles will be considerably more. Entrants must have the permission of the bill payer before calling.
    * SMS text to 64499– send text with A, B or C to indicate your answer; up to five entries per phone. Each text costs £1.00 plus one standard network rate message. Charges will be deducted from the entrant's available credit time if they are a pre-pay customer or appear on their monthly statement if they are a pay-monthly customer. SMS entrants will receive an SMS confirmation text message of their entry. Texts received outside competition opening hours may be eligible to be refunded.  Those eligible for a refund will receive a text instructing them how to claim that refund or make a charitable donation.
    * Online – go to www.gm.tv and follow the instructions; up to five entries per unique phone number (you will be asked to give your phone number as part of the online entry). There is no charge for online entries.
    * There is no email or postal entry available for the competition. Entries over the maximum number of entries for each method of entry or entries made or received by GMTV after the closing time will not be entered into the competition but may still be charged. Entries which are incomplete, incorrect, misspelt, inaudible, incomprehensible, or not received by GMTV are void but may still be charged.

3. Prize: The first entry drawn at random from all eligible entries who have answered the question correctly will win the prize. Click here to view details of prizes for televised competitions. The winner will be contacted on their phone number on the competition draw date. GMTV will not amend contact information provided. Reasonable efforts will be made to contact a winner. Failure to respond and/or provide an address for delivery may result in forfeiture of the prize. If they cannot be contacted, or are unable comply with these terms and conditions, GMTV reserves the right to offer the prize to the next eligible entrant.

For non-time critical televised competition prizes, the following contacting procedure will apply: the potential winner will be called at least three times (at three different times of day) per day including on a weekend for the first week after the draw date, then once per day (Monday to Friday at different times of day) for the following two weeks and three times (Monday to Friday at different times of day) during the fourth week after the draw date. If the potential winner cannot be contacted after at least twenty-eight days or if they are unable to comply with these terms and conditions, a second potential winner will be selected and the above calling procedure will be applied again. If that second potential winner cannot be contacted after at least twenty eight days, a third potential winner will be selected and so on.

4. Any person who is an employee or an immediate family member of an employee of GMTV Ltd or any other person who is directly connected with the organisation of any particular competition is ineligible to participate.

5. By entering the competition, entrants will be deemed to have read and understood these rules and be bound by them.

6. Competitions are only open to residents of the UK, Channel Islands and the Isle of Man.

7. Entrants must be at least 18 years of age unless otherwise stated.

8. All decisions of GMTV will be final and binding. No correspondence will be entered into.

9. No responsibility will be taken by GMTV for any answers that are illegible, misdirected, lost for technical or other reasons or received after the closing date.

10. If for any reason an advertised prize is unavailable GMTV reserves the right at its absolute discretion to substitute a similar prize of equivalent or greater value. None of the prizes may be exchanged or transferred and no cash alternative will be offered. Only one prize will be awarded per person. Please allow 28 days for delivery of all prizes.

11. Where prizes are to be provided by a third party then the winner(s) will be required to complete all appropriate or applicable booking or other formalities direct with such provider. GMTV will have no responsibility for the acts or defaults of any other persons.

12. GMTV reserves the absolute right to disqualify any entrant to any competition which it considers has used improper technical means to enter.

13. Prizes Involving Travel: (a) All travel, holiday, health or insurance shall be the responsibility of the prize winner(s) and not GMTV. (b) Holidays include accommodation & travel as described. Travel connections, additional charges, exit taxes, room service etc. are the responsibility of prize winners (c) Holidays are redeemable only by the named winner and must not be sold onto any other party. (d) For each holiday package prize, all travellers must travel at the same time on the same itinerary (e) All travellers must be in possession of a valid passport (f) Travel dates may be restricted to certain times of the year; (g) Unless otherwise stated, all travel and holiday prizes must be taken within one year of the date of the competition draw.

14. Use and Protection of Your Personal Information:
GMTV recognises that your privacy is important to you and we use the latest technologies & best practices to secure all personal information. GMTV aims to preserve your privacy at all times and will not disclose your personal information to third parties unless it is required to do so by law or it, in good faith, believes that such action is necessary to:
• Comply with the law or with legal process
• Protect and defend our rights and property
• Protect against misuse or unauthorised use of this website
• Protect the personal safety or property of our customers or the public (among other things, this means that if you provide false registration information or attempt to pose as someone else, information about you may be disclosed as part of any investigation into your actions)

Where required to do so, GMTV may pass on your personal information to a legal or regulatory body.

Lines are open 24 hours a day 7 days a week and you will always be charged for your message.

All text messages received by GMTV will be read. All messages will be moderated and GMTV reserves the right to edit, alter, or adapt your message in its absolute discretion. Messages which GMTV deems are abusive, defamatory or otherwise in poor taste will be deleted and so will not be displayed.

GMTV may display and/or mention on-air some messages received but no guarantee is given that any message will be featured on-air.

GMTV Voting Terms and Conditions

1. General Voting Guidelines

Viewers can vote by premium rate telephone service only, by dialling the numbers as specified in GMTV (the 'Programme'). Please note it is not possible to vote via SMS, the internet, red button or via e-mail.

Viewers in the United Kingdom can vote for whichever contestant (as indicated in the Programme) they want to keep in or win the competition (as applicable). The contestant with the most votes when the votes are calculated will be kept in or win the competition.

Each telephone vote costs 10p from a BT landline. Calls from other networks may be higher and from mobiles will be considerably more. The total cost will depend on the voter's network operator. Please ask permission from the bill payer before voting and please dial carefully and sensibly. There will be no refunds for the cost of any misdialled calls made.

Viewers may dial the numbers as displayed on the Programme. GMTV is committed to operating viewer voting fairly and to preventing abuse of its systems, as well as those of its agents and sub-contractors. Hence, GMTV reserves the right to discount votes if it has reasonable grounds to suspect, at its sole discretion, that fraudulent voting has occurred, such that is designed to excessively manipulate the outcome of the vote. Therefore we reserve the right to disqualify any votes made having regard to all circumstances and information available to GMTV at the relevant time.

If a contestant is unable to or is prevented from performing fully in the Programme due to medical reasons, or for other reasons which are beyond the control of GMTV, then GMTV will decide whether that contestant will continue in the competition, having regard to all circumstances and information available to them at the relevant time. The producers of the Programme will in their sole discretion determine if another contestant may be allowed to enter the competition.

Vote lines are opened and closed as specified on the Programme. Votes made or received outside of these specified times will not be counted and may be charged. Voting times are liable to change and GMTV may suspend, withdraw or re-set voting at its sole discretion at any time. GMTV may in its sole discretion at any time change the rules for voting.

GMTV, the producers of the Programme, their agents and sub-contractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any telephone network or line, system, server, provider, software or otherwise which may result in any vote being lost or not properly received, registered or recorded.

The result of the vote will be established from all votes received by the producer of the Programme at the time when the result is calculated, after the lines have closed. Please note that votes which have not been received by the producer of the Programme at the time when the result is calculated will not be counted but may still be charged.

GMTV cannot promise that the telephone lines will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. The system and/or service may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the reasonable control of GMTV, their agents and sub-contractors, and will not be liable to you or to any other person in the event that all or any part of the system and/or service is discontinued, modified or changed in any way.

GMTV will not have a say in the outcome of the vote. In the event that the outcome of a vote cannot be reasonably determined because of a technical failure or other circumstance beyond the reasonable control of GMTV, its agents or sub-contractors, then the judges' decision will determine which contestant stays in, leaves or wins the competition or any other decision which the vote would have determined. The judges' decision will be final.

Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.

2. Guidelines for Voting by Telephone

To vote by telephone, you may dial the premium rate telephone number, as displayed on the Programme, and listen to the instructions given in a short message.

Please note that as with any popular voting show, there are always very high call volumes when the voting first opens. Anyone having difficulties getting through to the voting lines should wait and then try calling again within voting times only.

Terms and Conditions

For the purposes of the following, the term "content" refers to any text, picture or video sent to GMTV.

You must be at least 16 years old to send content to GMTV. By submitting content, you agree to give GMTV a permanent, irrevocable licence to use your content as it thinks fit, and you waive any moral rights. Subject to the aforementioned, you will retain ownership of the copyright in your content, but grant GMTV a perpetual royalty-free right to exploit the same in any way it sees fit.

Permitted Content

Examples of content that will not be permitted on the site include, but are not limited to, the following:
• Violent, illegal or threatening behaviour
• Pornography
• Drug usage or promotion
• Racist content
• Content which may be considered defamatory, slanderous or libellous
• Content which invades individuals rights to privacy
• Copyright materials
• Content containing inappropriate or offensive language

GMTV may notify the Police or other appropriate authorities should it consider the content to be illegal.

GMTV will, in its sole discretion, determine the layout and placing of your content on the programme and website if it is used.

By sending content to GMTV you agree to these terms and conditions.

FAQs

Why does GMTV charge to send content to the show?

Together with a number of other broadcasters GMTV charges 25p for incoming text messages and 50p for picture and video messages. Some viewers are keen to use this as an easy way to communicate with us. We will read/view every message that comes in and all suitable messages may be displayed on the website.

GMTV does not actually receive 25p from each text, as the Network Operators and our mobile gateway take the lion's share. What GMTV does receive helps pay for the administration and staffing of this interactive mechanism.

It should be noted that GMTV is not running these services with a view to making a profit.

Will I receive text "spam"?

All SMS messages sent from GMTV can be identified by the word GMTV at the beginning. We do not supply mobile telephone numbers to any third party, except if required to do so for legal reasons.

Text spamming is caused by companies sending unsolicited text messages to randomly generated mobile telephone numbers. GMTV in no way supports this practise and takes great care to guard numbers from any unauthorised use.
